Terms & Conditions of Contract

  1. When “we”, “us”, "Company" or “our” is written, the reference is to Multi-Act Historical Portrayals.

  2. When “you” or “your” is written, the reference is to the person or entity requesting the presence of one of our portrayals.

  3. It is assumed that by requesting our services that you have read, understood and accept all of our terms and conditions.

  4. If you require one of our portrayals to bring weapons of any kind (rifle, pistol, dagger), a surcharge of £50 will have to be paid as part of the event deposit prior to agreement with us in addition to providing proof of permission for weapons to be carried at the event. This will be in addition to the other charges for the event.

  5. All drill events will include standard and weapons drill movements. With weapon drill, bayonets will be fixed to rifles, and drill movements will also cover movements with other weapons of the period, including the Bren gun. This will automatically have the Weapon Carriage Surcharge of £50 applied to it.

  6. If overnight work or travel is required (10pm - 7:30am), then a overnight surcharge of £42 per night will be required to be paid to cover unsocial hours.

  7. If the site of your event does not provide facilities for overnight accommodation or overnight accommodation is required before attending your event / booking at a location other than our Headquarters, a surcharge of £77 per night will be added to your invoice to cover the cost of overnight accommodation when it is required.

  8. All charges are non-negotiable, and if any attempt is made to bring the price down by negotiation or haggling, a penalty charge of £250 will be added to your invoice, with the possibility of being placed on a blacklist of events that we would not be willing to assist or attend.

  9. If you are deliberately misleading in your booking (eg booking a school talk in place of a talk at a larger event) a penalty charge of £250 will be added to your invoice (in addition to the difference in cost), with the possibility of being placed on a blacklist of events that we would not be willing to assist or attend in future. As deliberate misleading constitutes fraudulent behaviour by means of false representation, the appropriate authorities will be notified of the incident.

  10. If weapons are requested as part of a booking, the event is to provide a secure area for the weapons to be kept, and will be responsible for their security. As such, the event will be responsible for the exact replacement of any articles either misplaced, lost or stolen at an event when the articles are in the possession of the hosting organisation of the event or being held in a “safe” location in the event.

  11. If a training event requiring the presence of a Historical Portrayal available from Multi-Act Historical Portrayals will need to provide:

    1. A full plan of what it expected of us.

    2. A location for accommodation if the event is over multiple days.

    3. Pay the daily hire charge for the days of full activity.

    4. Pay the overnight working charge for nights of activity.

  12. If a training base owned by the Ministry of Defence is to be used for a training event, it is the responsibility of the hirer to obtain permission for use of the facility, in addition to obtaining the necessary permission for the use and carriage of weapons, usage of vehicles and usage of any buildings on site.

  13. Events hosted by branches of the Royal British Legion will be given a discounted rate. As a means of preventing fraud, you will be asked for proof of membership and branch name / number.

  14. Educational establishments looking to hire our services will be required to:

    1. Provide a basic plan of the services required.

    2. Provide the target audience by age group.

    3. Provide a space for the storage of equipment.

    4. Provide a space to deliver our services.

    5. Prepare the target audience to a suitable standard.

  15. Professional establishments looking to hire our services for special events are required to:

    1. Provide a basic plan of the service required.

    2. Provide the target audience by age group.

    3. Provide a space for the storage of equipment.

    4. Provide a space to deliver our services.

    5. Provide a plan of the event on a day by day basis.

    6. Provide a safe and secure location to lock equipment and possessions if our services are required over a number of days at the same location.

    7. Pay the daily hire charge for the days of full activity.

    8. Pay the overnight working surcharge for nights of activity.

    9. Pay the accommodation surcharge if the site is not permitting overnight camping.

  16. Living History Events looking to hire our services are required to:

    1. Provide a basic plan of the service required.

    2. Provide a space to deliver our services.

    3. Provide a location for overnight accommodation if our services are requested over the entire length of the event.

    4. Pay the daily hire charge for the days of full activity.

    5. Pay the overnight working charge for nights of activity.

    6. Pay the accommodation surcharge if the site is not permitting overnight camping.

  17. If a event develops a consistently positive professional relationship with us, it will only be at that point that repeated bookings will see discounted rates being made available to those events.

  18. The event deposit must be paid for events outside the Standard Operating Area (SOA) before the event can be confirmed.

  19. The Late Cancellation Fee will only be withdrawn in significant and mitigating circumstances (e.g. death of a relative (confirmation will be required in order to prevent the loss of income due to a fraudulent claim) or a lockdown (regardless of scale [eg city-wide, regional or national]) in result of a pandemic or terrorist attack).

  20. It is stressed that any verbal abuse or physical assault (including death threats and gestures indicating threats of bodily harm) aimed at staff of Multi-Act Historical Portrayals will be reported to the Police with charges being pressed against the person or persons responsible and the strongest penalties demanded. This will apply under every circumstance. It will also result in a £250 penalty charge being added and the immediate cancelling of the booking.

  21. If there is any attempted purchase or exchange of ownership of any of the equipment, uniform or weapons belonging to Multi-Act Historical Portrayals at your event, a penalty charge of £250 will be added to your invoice, and you will be permanently barred from booking our services again.

  22. If anyone at your event is caught in the process of attempting to steal anything belonging to Multi-Act Historical Portrayals, the person responsible will face legal action, and we will seek the strongest penalties. It will also see a penalty charge of £250 being added to your invoice, and you will be permanently barred from booking our services again.

  23. If your event / booking is to take place at a venue that is not on the UK Mainland, you are required to cover the costs of flights and hotels at the all inclusive rate as part of the event deposit.

  24. If your event / booking is to take place at a venue that is not on the UK Mainland, by placing a booking with us, you acknowledge that no weapons will be available due to international travel restrictions on what can be taken in and out of individual countries.

  25. If your event / booking is to take place in an environment where extra security personnel will be needed, you will be required to cover the costs of their hiring, travel and accommodation as part of the event deposit.

  26. As part of your event / booking, you must clearly point out emergency exit routes, as this is a legal requirement.

  27. If your booking is a virtual booking, the event is to be held on Zoom. Details will be forwarded to you for the meeting at least four working days prior to your booking.

  28. If anyone at the venue is given an instruction by a member of staff of Multi-Act Historical Portrayals or hosting event during the talk or session regarding appropriate actions when dealing with any possessions owned by Multi-Act Historical Portrayals, they are to do so for their own safety. Failure to do so will result in the event being immediately forfeited and possible legal proceedings.

  29. All photographs are only taken for official business purposes and as a means of covering Multi-Act Historical Portrayals on any insurance claims or potential legal proceedings.

  30. If any unforeseen circumstances prevent us from fulfilling our obligations (eg. staff ill-health), our liability will be limited to a refund of any money paid in relation to the event. No refunds of any money will be paid back to you in the event of you cancelling your event at the last minute. All requests of refunds should be made in writing within 48 hours of cancelling your event and sent to the contact email with the name of the booking and location used as the subject. All bookings are subject to availability and last minutes changes may occur.

  31. Photographs will be taken on site by staff of Multi-Act Historical Portrayals to show complete set up of equipment. This is also for reasons of evidence of property on display in the event of an attempted theft of property taking place.

  32. The exemptions from payment of fees or reduction in payment of fees is only applicable in the following circumstances:

    1. A museum or establishment that does not charge an admission fee for general members of the public who are not part of a supporting body (ie a "Friends of" scheme)​

    2. A museum or establishment that has a contract of good standing with Multi-Act Historical Portrayals

    3. The venue or establishment that is hiring us has a Multi-Act Historical Portrayals-issued Service Discount Card

    4. A member of staff belonging to Multi-Act Historical Portrayals decides at the start of our participation in your event to waiver selected or all fees.​

  33. We reserve the right to refuse to give "back-to-back" talks on events without a reasonable period of time between each talk.

  34. We reserve the right to refuse entry at one of our hosted events or one of our talks to any person or persons who are blacklisted from attending any function where we are attending.

Supplemental Terms and Conditions or documents that may be posted on the website from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these terms and conditions from time to time. We will alert you about any changes by updating the "last updated" date on these terms and conditions, and you waive any right to receive any specific notice of each such change. Please ensure that you check the applicable Terms every time you use the site, so that you understand which terms apply. You will be subject to, and deemed to have been aware of and accepted, the changes or modification to any revised Terms and Conditions by your continued use of the website after the date such revised Terms & Conditions are posted.

Site Management

We reserve the right, but not the obligation, to: (1) monitor the website for violations of these Terms and Conditions; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms and Conditions, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent of technologically feasible) any of your contributions or any portion thereof; and (4) otherwise manage the website in a manner designed to protect our rights and property and to facilitate the proper functioning of the website.

Modifications and Interruptions

We reserve the right to change, modify, or remove (either in part or in full) the contents of the website at any time for any reason at our sole discretion without notice. However, we have no obligation to update any information on our website. We also reserve the right to modify, discontinue all or part of the website without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension or discontinuance of the website.

We may experience hardware, software, or other problems or need to perform maintenance related to the site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue or otherwise modify the website at any time for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the website during any downtime or discontinuance of the website. Nothing in these Terms & Conditions will be construed to obligate us to remain and support the website or to supply any corrections, updates or releases in connection therewith.

We care about privacy and security. By using our website, you hereby agree to be bound to our privacy policy posted on this site, which is incorporated into these Terms and Conditions. Please be advised that this site is hosted in the United Kingdom. If you access this website from any other region of the world with laws or other requirements governing the use of personal data other than those laid down by the General Data Protection Regulations 2016, then through your continued use of the website, you agree to have your data transferred to and processed in the United Kingdom.​

Term and Termination

These Terms and Conditions remain in full force while you remain in use of the website. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS AND CONDITIONS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION, AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE WEBSITE (INCLUDING BLOCKING CERTAIN IP ADRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR CONENANT CONTAINED IN THESE TERMS AND CONDITIONS OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OF THE WEBSITE AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.

If we terminate or suspend your access to the website for any reason, you are prohibited from accessing the website, even if you are acting on behalf of a third party. In addition to terminating or suspending your access, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

We will maintain certain data that you transmit to the website for the purpose of managing the performance of the website, as well as data to see your use of the website. By your continued use of the website, you agree that we shall have no liability to you for the loss or corruption of any such data, and you hereby waive any right of action against us from any such loss or corruption of any such data.

These Terms & Conditions and any policies or operating rules posted by us on the website or in respect of the website constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce these Terms and Conditions shall not operate as a waiver of such right or provision. These Terms and Conditions operate to the fullest extent permissible by law. We may assign any or all of our rights to others at any time. We shall not be responsible or liable for any loss, damage, delay or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms is deemed to be unlawful by a court of law or void or unenforceable, then that provision or part of that provision is deemed severable from these Terms & Conditions and does not effect the validity and enforceability of any of the remaining provisions or parts thereof. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms and Conditions or use of the website. You agree that these Terms and Conditions cannot be construed against us by virtue of having drafted them. You hereby waive any and all defenses that you may have based on the electronic form of these Terms and Conditions and the lack of signing by the parties hereto to execute these Terms and Conditions.

Any user of the Multi-Act Historical Portrayals website may not make a claim against it for any reason, especially as no money is taken through the website and sales are hire agreements are subject to a separate written contract.
